PERSONAL DATA PROTECTION NOTICE

Misyail Othman & Co (MONCO) is dedicated to protecting the privacy of your personal data.  This Personal Data Protection Notice (“Notice”) outlines how MONCO gathers, utilizes, and secures the Personal Data you provide.

By sharing your Personal Data with MONCO through communication, engaging MONCO for the services you have requested (“Services”), and/or accessing MONCO’s Website at https://monco.my (“Website”), you are deemed to consent to the processing of your Personal Data by MONCO.

 

COLLECTION OF PERSONAL DATA

  1. “Personal Data” refers to any personal identification details that you have provided or will provide to MONCO, including but not limited to your name, contact details, address, email address, NRIC number, passport number, or bank account information.
  2. In addition to the Personal Data you provide directly to MONCO (such as during communication with MONCO or when engaging MONCO for Services), MONCO may also gather Personal Data from other sources.  These sources of data may include online search engines, public registries/databases, and legally obtained information from third parties.
  3. By providing MONCO with the Personal Data of third parties (such as your spouse, family members, or colleagues), you confirm that you have obtained their consent for MONCO to process their Personal Data.
  4. Please note that, supplying your Personal Data to MONCO is voluntary.  However, if you choose not to provide your Personal Data, MONCO may not be able to offer the Services you seek or communicate effectively with you.

 

PURPOSE OF PROCESSING OF PERSONAL DATA

      1.MONCO may use and process your Personal Data for its business purposes, including but not limited to the following:

  1. To fulfill the Services you have requested;
  2. To prepare any necessary documents or instruments related to the Services, such as agreements, contracts, or legal documents (e.g., loan agreements, sale and purchase agreements, tenancy agreements), as well as cause papers and affidavits;
  3. To provide required information to regulatory or governmental authorities in compliance with legal or regulatory requirements;
  4. For MONCO’s internal administrative purposes, including invoicing, billing, record-keeping, and conducting conflict of interest checks;
  5. To facilitate communication between MONCO and you and/or
  6. To ensure MONCO complies with its legal and regulatory obligations under the law.

 

DISCLOSURE OF PERSONAL DATA

  1. Your Personal Data supplied to or obtained by MONCO will be kept private by MONCO.
  2. Should MONCO be required to engage third-party companies, service providers, or individuals to perform certain services on its behalf, you hereby agree and consent to MONCO disclosing and transferring your Personal Data to these third parties, whether located within or outside Malaysia.  This may include but is not limited to, banks and financial institutions, storage facility providers, courier service providers, insurance providers, external advisors, and other professionals, such as company secretaries, lawyers, auditors, or other parties that MONCO deems needful for the purposes mentioned above.
  3. MONCO may also disclose and transfer your Personal Data to any statutory bodies, regulatory bodies, and/or governmental authorities where we are legally required to do so.

  1. MONCO pledges to take all reasonable steps and safeguards to ensure the data you have provided to us is kept securely from any unauthorized access, unlawful alteration, and disclosure. In the event that your data needs to be processed by a third party, we will ensure that such parties adhere to our stringent security standards and protocols.

  1. MONCO’s Website may contain links to other sites and pages. MONCO shall not be responsible for any Personal Data or information that you may provide to other entities through these links.

 

REQUEST FOR ACCESS AND INQUIRIES

  1. You may at any time request access to, or correction of your Personal Data or limit the processing of your Personal Data by MONCO by contacting the following:

  2. Please take note that, under certain conditions, the Firm reserves the right to decline your request to access your Personal Data or to refuse to make corrections.  Additionally, the Firm may impose a fee for accessing your Personal Data, in compliance with applicable law.
  3. If there are any changes to your Personal Data, you are obliged to promptly notify MONCO via the contact details set out above. Upon receiving your updated information, we will make the necessary changes to our records.
 

 

REVISION

MONCO reserves the right to update or modify this Notice from time to time.

This Personal Data Protection Notice is available in both English and Bahasa Malaysia.  In the event of any inconsistencies or discrepancies between the two versions, the English version shall take precedence.
